TERMS AND CONDITIONS OF THE SERVICE
GENERAL PROVISIONS
These conditions are valid only between the individual company TOBE SKINS of Montefusco Tobia Registered office: Viale Principe Amedeo 37 83029 – Solofra (AV) VAT number: 02881880641 and any person who makes purchases online on the website www.tobe212.it, hereinafter referred to as “CUSTOMER”. These conditions may be subject to changes, the date of putting online is equivalent to the date of entry into force.
These general conditions govern purchases made on the website www.tobe212.it, in accordance with articles 50 and following of Legislative Decree n. 206 of 6 September 2005, Consumer Code, section II of Chapter I of the third Title of the Third Part, to which reference should be made as provided for by art. 60 of the Consumer Code.
ARTICLE 1 – OBJECT OF THE CONTRACT
With these general conditions of sale, TOBE SKINS di Montefusco Tobia sells and the CUSTOMER remotely purchases the tangible movable goods indicated and offered for sale on the website www.tobe212.it. The contract is concluded exclusively through the internet, by accessing the CUSTOMER at the address www.tobe212.it and the creation of a purchase order according to the procedure provided by the site itself.
ARTICLE 2 – CONCLUSION AND EFFECTIVENESS OF THE CONTRACT
1. The sale will be considered concluded with the dispatch by TOBE SKINS di Montefusco Tobia to the CUSTOMER with an e-mail confirming the order. The e-mail contains the details of the CUSTOMER and the order, the price of the goods purchased, the transport costs and the shipping address to which the goods will be sent. The CUSTOMER undertakes to verify the correctness of the data contained therein and to promptly communicate any corrections.
2. TOBE SKINS di Montefusco Tobia undertakes to describe and present the items sold on the site in the best possible way. Nevertheless, some errors, inaccuracies or small differences between the site and the actual product may emerge. Furthermore, the photographs of the products presented on the site do not constitute a contractual element, as they are only representative.
3. TOBE SKINS di Montefusco Tobia undertakes to deliver the goods within 30 days from the day following that of the order confirmation by the CUSTOMER.
ARTICLE 3 – AVAILABILITY OF PRODUCTS
1. The availability of the products refers to that present when the CUSTOMER consults the product data sheets; this must in any case be considered purely indicative because, due to the simultaneous presence on the site of multiple users and physical customers in the store, the products could be sold to others before the order is confirmed.
2. Even after sending the order confirmation e-mail by TOBE SKINS di Montefusco Tobia, there may be cases of partial or total unavailability of the goods. In this case, the CUSTOMER will be promptly informed and will be able to decide whether to accept the delivery of only the products available or request the cancellation of the order by communicating it via e-mail to customer service.
ARTICLE 4 – METHOD OF PAYMENT
1. Any payment by the CUSTOMER can only be made with the payment methods indicated on the site (Credit Card or Paypal).
1.1 Through Paypal it is possible to pay by credit / prepaid card or by Paypal account (rechargeable by bank transfer or credit / prepaid card). Paypal does not involve any additional cost. For payments made by Paypal, if the unavailability of a product is detected after the registration of the order and the reservation of the amount on the card, TOBE SKINS di Montefusco Tobia will take the necessary measures with the payment operator to cancel the transaction relating to the unavailable goods.
2. The communications relating to the payment and the data communicated by the CUSTOMER when this is done take place on special protected lines and with all the guarantees ensured by the use of the security protocols provided by the payment circuits.
ARTICLE 5 – PRICES
1. All sales prices of the products displayed and indicated on the site are expressed in Euros and include VAT. In the case of purchase by non-EU consumers, the VAT will be reduced at the time of payment and the duties (not included in the price) must be paid upon delivery to the courier.
2. Shipping costs are included in the purchase price.
3. The CUSTOMER accepts the right to TOBE SKINS di Montefusco Tobia to change its prices at any time, however the goods will be invoiced on the basis of the prices indicated on the site at the time of the order and confirmed in the e-mail sent by TOBE SKINS di Montefusco Tobia as confirmation of the acquisition of the order.
ARTICLE 6 – PRODUCT WARRANTY
All the products presented on the site benefit from the legal guarantee of 24 months for lack of conformity, in accordance with current legislation. To use the warranty, the CUSTOMER must keep the invoice.
ARTICLE 7 – METHOD OF DELIVERY
1. TOBE SKINS di Montefusco Tobia will only accept orders to be delivered in the territory of the European Union. The products will be delivered by express courier to the address indicated by the CUSTOMER at the time of the order.
2. If requested by the Customers at the same time as the Orders are sent, TOBE SKINS di Montefusco Tobia will send customers a regular invoice, by e-mail or post. For the purpose of issuing the invoice, the information provided by the Customers prevails. No variation of the invoice will be possible after its issue by MA.GI.srl.
ARTICLE 8 – LIABILITY
1. TOBE SKINS di Montefusco Tobia does not assume any responsibility for disservices attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disservices of the internet, in the event that it fails to execute the order within the time stipulated in the contract.
2. The availability of each item is indicative only, has no contractual character and the seller cannot be held liable in the event of unavailability of one or more products.
ARTICLE 9 – ACCESS TO THE SITE
The CUSTOMER has the right to access the site for consultation and making purchases. No other use, in particular commercial, of the site or its content is permitted. The integrity of the elements of this site, whether audio or visual, and the related technology used remain the property of TOBE SKINS di Montefusco Tobia and are protected by intellectual property rights.
ARTICLE 10 – COOKIES
The website www.tobe212.it uses “cookies”. Cookies are electronic files that record information relating to the CUSTOMER’s navigation on the site (pages consulted, date and time of consultation …) and that allow to offer an increasingly personalized service to its customers.
ARTICLE 11 – INTEGRALITY
These General Conditions of Sale are made up of all the clauses that compose them. If one or more provisions of these General Conditions of Sale is considered invalid or declared as such pursuant to the law, regulation or following a decision by a court with jurisdiction, the other provisions will continue to have full force and effect.
ARTICLE 12 – APPLICABLE LAW AND COMPETENT JURISDICTION
These General Conditions of Sale are subject to Italian law. Any dispute that does not find an amicable solution will be submitted to the exclusive jurisdiction of the Court of the CUSTOMER’s place of residence or domicile, if located in the territory of the State.
